Approved Document S — Building Regs Part S

Since 15 June 2022, Approved Document S of the Building Regulations (England) has required EV charging provision in new buildings and certain major renovations. In summary:

  • New residential buildings with associated parking — every dwelling with a parking space gets a charge point; where the residential development has more than 10 parking spaces, additional cable routes are required for spaces not directly served.
  • New non-residential buildings with more than 10 parking spaces — at least one charge point, plus cable routes (passive provision) for one in five remaining spaces.
  • Major renovations creating >10 parking spaces — equivalent provision applies where the parking is being altered. The regulations apply to England; Wales, Scotland and Northern Ireland have separate but broadly similar regimes.

Approved Document S applies to new build and major renovation, not to existing untouched stock. For an existing apartment block adding EV charging today, Part S is the design reference rather than a legal requirement.

Typical multi-tenant scope

  • Shared 7–22 kW AC bays in a common car park — billed through a CPO back-office, RFID or app-based.
  • Allocated bay charging — one bay per leaseholder, each socket on a sub-meter; electricity billed to the tenant directly.
  • Landlord master supply + DNO upgrade — where the existing supply can't take 10–40 sockets, the landlord may need a new connection. Whether that cost sits with the freeholder, leaseholder service charge, or the CPO concession is a legal and commercial question, not a technical one.

The grant picture

  • The EV Chargepoint Grant for landlords supports landlords installing chargepoints in residential rental properties — check the live OZEV pages for the current cap, per-applicant ceiling and eligibility before applying.
  • The Workplace Charging Scheme applies where the parking serves a workplace tenant — including multi-let industrial estates where each tenant is itself a business with eligible off-street staff parking.

What is Approved Document S and does it apply to my building?
Approved Document S of the Building Regulations (England) sets EV-ready provision standards for new build and major renovation. In force since 15 June 2022, it requires charge points and cable routes in new residential and non-residential buildings with associated parking, scaled to the number of parking spaces. It does not retrospectively apply to existing untouched buildings.
Who pays for the supply upgrade in a multi-tenant block?
There is no single statutory answer. Costs typically sit with the freeholder/management company, are recovered through the service charge, or are funded by a CPO concession in exchange for revenue. The right answer depends on the lease terms and what the leaseholders consent to — get legal advice before signing.
Can leaseholders install their own charger on a private bay?
